DMCA Policy
Ohana Gift respects the work of artists, photographers and designers. If you believe a design or image on ohanagift.com uses your copyrighted work without permission, you can ask us to remove it under the Digital Millennium Copyright Act (DMCA). We review every notice and act quickly on valid ones.
Sending a takedown notice
Email your notice to support@ohanagift.com with “DMCA Notice” in the subject line. To be complete, it should contain:
- Your full name, mailing address, phone number and email address.
- A description of the copyrighted work you say is being infringed, or a link to where it is published.
- The exact page address (URL) on our site where the disputed material appears, so we can find it.
- A statement that you sincerely believe the use is not permitted by the copyright owner, the owner’s agent or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you own the copyright or may act for the owner.
- Your physical or electronic signature (typing your full name is enough).
What happens next
When a complete notice arrives, we remove or disable the listed material, let you know it has been taken down, and inform the person who submitted the content, where there is one. Incomplete notices may delay action, so please include every item above.
Counter-notice
If content you supplied was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same email address. Include your contact details, identify the removed material and where it appeared, state under penalty of perjury that you believe it was removed by mistake, consent to the jurisdiction of the appropriate court, and sign the counter-notice. Unless the original complainant tells us that they have filed a court action, the material may be restored after the period set out in the DMCA.
Repeat infringement
We stop accepting personalization uploads or orders from anyone who repeatedly submits content that infringes the rights of others.
Please note
Knowingly misrepresenting that material infringes, or that it was removed by mistake, can make you liable for damages. If you are unsure whether something infringes your rights, consider speaking with a lawyer first.
